Messaging Terms.

The rules every Textually customer accepts before texting: consent, lists, content, opt-outs, and who carries the responsibility when something goes wrong.

Version of October 14, 2026. Draft under legal review.

1. What these terms cover

These Messaging Terms apply to every text message sent through Textually by you, your team or anyone using your workspace. They sit alongside your agreement with Textually. By importing a list, setting up Push to campaign or launching leads, you confirm you accept them.

You text only people who agreed to receive texts from your business. For marketing texts in the United States that means prior express written consent; for texts to people in Canada it means express or implied consent under Canada’s Anti-Spam Legislation (CASL); and in every case it means the consent the carriers expect under their messaging guidelines.

You keep a record of each person’s consent (where, when and the wording they agreed to) for at least four years, and you send it to us within five business days when we, a carrier or a regulator asks.

Every time you tick the consent statement in Textually, you confirm this for the list or leads in front of you. We store each confirmation with your name, the time and the wording.

3. Lists you may not use

You use only lists your business collected itself. Bought, rented, shared, scraped or appended lists are not permitted, and neither is consent gathered for another business.

4. What you may send

Your texts identify your business, are truthful, and match the use case you registered with us. You follow the carriers’ content rules, including their restrictions on sex, hate, alcohol, firearms, tobacco, cannabis, gambling, sweepstakes, high-risk financial offers and debt collection, and you send no phishing, malware or deceptive links.

You respect the sending hours that apply to the people you text, including stricter state rules.

5. Opt-outs

Textually adds the registered opt-out line to each text until the person replies and stops texting anyone who replies with STOP or another opt-out word. You honour opt-outs that reach you any other way (by email, phone or in person) by marking the lead in Textually right away, and you never re-add someone who opted out unless they opt in again.

6. Carrier and registration consequences

Carriers and The Campaign Registry review, filter, fine and suspend senders. If your texts, lists or consent records lead to a carrier fine, extra fees, a rejected or suspended brand or campaign registration, or blocked numbers, your business is responsible for those costs and for the cost of any new registration.

Where a carrier or registry names your traffic, we pass the charge to you at cost, and you pay it with your next invoice.

7. What we may do to protect the network

To protect your numbers, our other customers and our standing with the carriers, we may review your lists, consent records and messages; pause a campaign, a number or your workspace; refuse or withdraw a registration; and end your account when these terms are broken. Where we can, we tell you first and give you a chance to fix the problem.

8. Responsibility for claims

You are responsible for, and will defend and cover Textually against, claims, fines, penalties, damages and costs (including reasonable legal fees) that arise from the texts you send, the lists you upload, missing or invalid consent, or a breach of these terms.

9. Changes

We may update these terms as laws and carrier rules change. Each version has a date; the version you accepted is stored with each confirmation. This version: 2026-10-14. Questions: hello@usetextually.com.
